We, the Arizona Association of Chiropractic, are proud to be a dynamic, proactive advocate of chiropractic, the patients it serves, and the licensed doctors it represents.

Knowing that chiropractic is 21st Century health care, we are working together, enlightening the public, and striving to keep chiropractic a key player in the delivery of health care and wellness to the people of Arizona and the nation. We see the expanding demand for chiropractic requiring an Association that promotes the profession, safeguards the rights of our practitioners, and provides exceptional communication and service to our member doctors.

As an Association we strive for equal recognition and participation for chiropractic in government health care programs, private insurance plans, and in all other health care arenas which impact the delivery of health care to the people of Arizona.

HB2132 Update
Today was the first of what will likely be several meetings regarding HB2132 and the overall issue of holding the Department accountable.  BarryM. Aarons, AAC lobbyist and Renee Haberl, DC, AAC President attended the meeting with a select group of insurance industry lobbyists and a couple of other interested parties that was initiated by bill sponsor Representative Jeff Dial.  Representative Dial is setting another meeting strongly requesting the presence of the Department of Insurance, as it was determined today that their response to questions raised about DOI accountability is essential.  We will continue to update you as to the progress of this bill.

Proposed Bill Would Require Action

By the Department of Insurance to

properly enforce the law!

House Banking and Insurance Committee Vice Chairman Jeff Dial

to introduce legislation

requiring Department of Insurance to investigate complaints,

make determinations on those complaints,

notify the complainants of their determinations and enforce the law

when violations are found!

 

The Arizona Association of Chiropractic continues to seek practical and rational solutions to the critical issues that are besetting our profession:

·        Perceived violations by insurance companies and their third party administrators of the unfair claims practices act; and,

·        A recalcitrant Arizona Department of Insurance that refuses to investigate the myriad of complaints filed by chiropractic physicians and their patients. The problem is not whether Blue Cross, Cigna or any insurance company is adhering to the law. The problem is that the Insurance Department Director does not feel that she has a duty to enforce the law, "even if they did violate 461 (the Arizona Unfair Claims Practices Act)." That, in and of itself is breath taking! And a legislature that abhors over regulation dislikes regulators who thumb their noses at the law even more so.

The most effective and efficient way to deal with these problems at this time and to effect some long term solution is to require that the Department of Insurance look into our claims, make a determination, and, if warranted to enforce their findings pursuant to the law.

That is why House Banking and Insurance Vice-Chairman, Representative Jeff Dial (Republican - District 20 - Chandler), will introduce legislation in the regular session of the Arizona Legislature that begins next Monday, January 9th that will require the Department of Insurance to investigate complaints, render a determination on those complaints, notify the complainant of their determination and enforce any violations with the authority to fine the offending party. In addition the legislation will require that utilization review boards include a chiropractic physician and require that physician to be licensed in Arizona.

This will be an uphill battle. But if insurance companies are confident that they are not violating the Unfair Claims Practices Act then they should have no objection to fair and full investigations by the Department of Insurance.

If successful this legislation could take affect by early next summer enabling review of our complaints and a determination as to whether our contentions are, as we believe, indeed valid.

 

 

Important Notice - CMS 2012 Fee Schedule

The ACA has recently received several inquiries regarding 2012 fee schedules posted on their contractor web sites. It is important to note that if your contractor has posted 2012 payment rates, these rates are NOT correct. They are reflective of the 2012 Physician Fee Schedule Final Rule that was put on display at the Office of the Federal Register on November 1, 2011, which provided a 27.4 percent negative update for 2012. On Dec. 23, House and Senate leaders voted to extend a Social Security tax cut, which included a provision that delays--for two months--the cut in reimbursement to Medicare providers, including doctors of chiropractic. Therefore, Medicare will continue paying doctors at 2011 rates until March 1, 2012.
It is also important to note that on Dec.17 the Centers for Medicare and Medicaid Services (CMS) instructed its Medicare claims administration contractors to hold claims containing 2012 services paid under the MPFS for the first 10 business days of January 2012 (i.e., Sun Jan 1 through Tue Jan 17). The hold should have minimal impact on provider cash flow because, under current law, clean electronic claims are not paid sooner than 14 calendar days (29 days for paper claims) after the date of receipt.

You will then be supplied needed access information.

 

If you are not an AAC Member, you will find a link to a membership application on the website, or on the inside back page of the AAC Journal (which are archived under the AAC Journal tab on the Homepage).
